EPA Sued Over Repeal of Power Plant Climate Regulations

Lawsuit Filed Against EPA

The Environmental Protection Agency (EPA) is facing a lawsuit after finalizing a rule to eliminate climate regulations for power plants. The American Lung Association, American Public Health Association (APHA), Clean Air Council, Clean Wisconsin, Environmental Defense Fund, and Natural Resources Defense Council (NRDC) filed a petition with the US Court of Appeals for the DC Circuit.

Allegations of Conflict with Clean Air Act

The petition requests a review of whether the EPA's action conflicts with the Clean Air Act. Opponents argue the repeal is short-sighted and leaves the largest source of industrial climate pollution unchecked. APHA CEO Georges C. Benjamin stated the EPA is weakening "life-saving standards" and removing "vital protections."

Public Health Concerns

Benjamin warned that the rule change could lead to thousands of premature deaths and disproportionately affect vulnerable populations, including children, pregnant people, and communities already burdened by pollution. He emphasized that power plant pollution threatens millions of Americans and exacerbates climate change impacts like extreme heat and poor air quality.

EPA's Justification and Opposition's Stance

The EPA stated its action was based on "the best reading of the Clean Air Act." However, Benjamin and other critics disagree, asserting that the EPA must maintain strong clean air and climate standards. Meredith Hankins, NRDC’s federal climate legal director, accused the EPA of abdicating its legal responsibilities and expressed confidence the repeal will not withstand court scrutiny.
