FCC Moves to Dismiss Disney Lawsuit

The Federal Communications Commission (FCC) has urged a court to dismiss a lawsuit filed by Disney. Disney's lawsuit challenges the FCC's decision to initiate an early license review for eight broadcast stations owned by ABC. The FCC's motion seeks to allow the agency to continue a proceeding that could result in the nonrenewal of ABC’s broadcast licenses.

Disney's Allegations of Censorship

Disney filed its lawsuit on August 18, asserting that the FCC is engaged in a "campaign of censorship." Disney claims this campaign is retaliatory, targeting ABC for content perceived as critical of President Trump. This legal action follows continued attacks by Trump on media outlets, including demands for the FCC to penalize journalists.

Watchdog Groups Seek Intervention

Two watchdog groups and individual viewers of ABC stations are attempting to intervene in the lawsuit. Their concern is that Disney might reach a settlement with the FCC that does not align with public interest. Disney has opposed this motion, and a judge will decide whether these groups and individuals can participate as intervenors.

FCC's Stated Reasons for Review

The FCC's filing in the US District Court for the District of Columbia defends the early license review. While FCC Chairman Brendan Carr has previously threatened ABC over content from shows like Jimmy Kimmel and The View, the FCC states the review is strictly about "allegations of unlawful discrimination" related to Disney’s diversity, equity, and inclusion (DEI) policies. The FCC maintains that no decision has been made regarding the licenses and that Chairman Carr is "open-minded."
