Apple reports delays in Jon Prosser's response to leak lawsuit, citing newborn child

Lawsuit Background

Apple sued Jon Prosser and Michael Ramacciotti last year over videos in which Prosser leaked details of an iOS 26 redesign. The lawsuit accuses them of misappropriating trade secrets and violating the Computer Fraud and Abuse Act by accessing an Apple employee's development iPhone to publish leaks.

Previous Delays and Default

While Ramacciotti cooperated with discovery requests, Prosser initially failed to formally respond to the lawsuit, leading to a default judgment against him. Prosser's lawyer successfully requested to set aside the default in June, allowing the case to proceed with an initial round of discovery where Prosser provided documents and sat for a deposition.

Current Status and Further Delays

In a joint status report filed yesterday, Apple indicated limited progress since the initial discovery phase. Apple's counsel last heard from Prosser's counsel a month prior, despite repeated attempts to communicate. Prosser's counsel explained that the delay was due to Prosser attending to his newborn child. Apple also noted outstanding discovery issues and deficiencies in Prosser's productions.

Co-defendant's Cooperation

The report, signed by attorneys for all parties, also stated that co-defendant Michael Ramacciotti has agreed to supplement his interrogatory responses and will sit for a second deposition in September.
