The U.S. Environmental Protection Agency (EPA) has released new guidance stating that power generation facilities not connected to a public electricity grid, known as 'islanded' facilities, are not subject to the Clean Air Act (CAA) Acid Rain Program (ARP). This clarification specifically impacts power sources developed for data centers that operate independently of the main grid.

Implications for Data Center Development

This guidance is intended to offer data center developers more flexibility in selecting locations and accelerating construction timelines for new facilities. By exempting islanded power generation from the ARP, the EPA aims to reduce regulatory burdens and potentially lower costs associated with power infrastructure for these specialized facilities.

Alignment with Administration Priorities

The EPA's decision aligns with President Donald Trump's Ratepayer Protection Pledge, which encourages companies to cover the full cost of their energy needs and supporting infrastructure. Assistant Administrator for Air and Radiation Aaron Szabo stated that this guidance supports both maintaining U.S. artificial intelligence dominance and safeguarding communities from utility price increases.

Technical Basis for Exemption

The EPA's interpretation of the CAA indicates that the ARP applies to facilities that sell electricity or are required to report as a generating unit to the U.S. Department of Energy (DOE). Since islanded power generation facilities neither sell electricity nor have mandatory DOE reporting, they are deemed outside the scope of the ARP. However, if such a facility later connects to the grid, it may then become subject to the program's provisions.
