Texas Governor Halts Data Center Environmental Permits Amid Grid Audit

This directive will remain in effect until the Electric Reliability Council of Texas (ERCOT) finishes an audit of the current waitlist for data centers seeking to connect to the state's power grid.

Expansion of Existing Moratorium

This order broadens a moratorium initially issued in August by the governor's office, which halted new data center grid approvals. The new directive extends this pause to include environmental approvals managed by the Texas Commission on Environmental Quality (TCEQ).

Potential Market Impact

Texas was projected to become the world's largest data center market by the end of the decade, according to a February JLL report. However, this new directive could slow that progress. BloombergNEF analysts estimate that nearly 50 gigawatts of proposed data center capacity, representing almost 20% of the U.S. total, could be at risk, potentially leading to over $8 billion in revenue losses by Q1 2027.

Political and Public Context

The data center buildout has become a significant issue in the upcoming 2026 midterm election, with an NBC News poll indicating that 64% of Americans would be less inclined to vote for a candidate supporting local data center construction. Governor Abbott, who previously promoted Texas as an "epicenter of AI development" due to incentives and projects like OpenAI's Stargate, has now reversed course. His office stated that he will work with the Legislature to eliminate financial incentives for data centers in the next session.
